What should be the size of the BaWü emergency exit?

According to the LBO in BaWü, the egress opening must be "at least 0.90m wide and 1.20m high in clear view". Can anyone tell me if the term "clear" means the distance to the frame (= when the window is open)? Or does it apply when the window is closed (=window panel size)?
